DMCA TAKEDOWN REQUEST

The following guide outlines how to file a DMCA complaint and the steps we take to address such concerns.
1. UNDERSTANDING THE DMCA
The Digital Millennium Copyright Act (DMCA) is a U.S. copyright law designed to protect intellectual property owners from the unauthorized use of their works online. 2. FILING A DMCA TAKEDOWN REQUEST

2.3. IDENTIFICATION OF THE INFRINGING MATERIAL:
Provide a detailed description of the specific content on our website that you believe infringes your copyright. This should include the exact URL (web address) where the infringing material is located, and any additional information that will help us locate the content quickly.
2.4. A STATEMENT OF GOOD FAITH:
Include a statement declaring that you have a good-faith belief that the use of the material in question is not authorized by the copyright owner, their agent, or the law. This statement should be worded as follows:
“I have a good faith belief that the use of the material identified is not authorized by the copyright owner, its agent, or the law.”
2.5. A STATEMENT OF ACCURACY AND AUTHORITY:
You must also include a statement attesting to the accuracy of your claim and your authority to act on behalf of the copyright holder. This statement should be worded as follows:
“I declare, under penalty of perjury, that the information contained in this notice is accurate and that I am the owner, or am authorized to act on behalf of the owner, of the copyright that is allegedly infringed.”
2.6. YOUR SIGNATURE:
The complaint must include your physical or electronic signature to be valid. If you are submitting the request via email, typing your name at the end of the document will suffice as an electronic signature.

4. OUR RESPONSE TO A DMCA TAKEDOWN REQUEST
Upon receiving a valid DMCA takedown request, Godoi Consulting will take the following steps:
– Review the Request: Our legal team will promptly review the DMCA request to determine its validity. We will ensure that all required information is provided and that the claim is legitimate.
– Remove or Disable Access to the Infringing Content: If we find that the request is valid, we will remove or disable access to the infringing material on our website.
– Notify the Alleged Infringer: We will notify the user or entity that posted the alleged infringing content, informing them of the DMCA takedown request. The alleged infringer will also be provided with information on how to file a counter-notification if they believe the takedown was made in error.
5. COUNTER-NOTIFICATION PROCESS
If you are the owner of the content that was removed from our website due to a DMCA takedown request and believe that the removal was made in error, you have the right to file a counter-notification. The counter-notification must include the following:

Include a statement declaring your good-faith belief that the material was removed as a result of a mistake or misidentification. This statement should be worded as follows:
“I have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.”
5.4. A STATEMENT OF CONSENT TO JURISDICTION:
You must include a statement consenting to the jurisdiction of the federal court in the district where you reside (or where the company is located, if you are outside the United States), and that you will accept service of process from the party who filed the original takedown notice or their agent.
5.5. YOUR SIGNATURE:
As with the takedown request, the counter-notification must include your physical or electronic signature.
Once we receive a valid counter-notification, we will review the claim and notify the original complainant. If the original complainant does not file a lawsuit within 14 business days to prevent the re-posting of the content, we will restore the material to our website.
6. PENALTIES FOR FALSE CLAIMS
It is important to note that under the DMCA, both copyright holders and individuals accused of infringement are subject to penalties for making false claims. Filing a false DMCA takedown request or counter-notification can result in significant legal consequences, including damages and legal fees. We encourage all parties to ensure that their claims are legitimate before submitting them.
